Register of Deeds

The register of deeds has the power to take acknowledgments, administer oaths, and certify the same by his or her signature. The register must keep a book in which every instrument filed for record in his or her office is entered and an official seal. The register of deeds may appoint one or more deputies for whose acts the register will be responsible. The deputy may not be the county treasurer, sheriff, clerk or surveyor. If a register of deeds is not elected pursuant to section 32-518, the county clerk shall act as ex officio register of deeds.

Filing Fees

The cost to record a document is $10.00 for the first page and $6.00 for each page following. A UCC Fixture Filing will cost a flat rate of $14.00; however, a Termination of a UCC Fixture Filing will have no filing fee.

Documentary Stamp Tax

Pursuant to NE LB78, effective September 3, 2025, Documentary Stamp tax for Nebraska increased to $2.32 per $1,000. If you have any questions, please reach out to the Nebraska Department of Revenue.

Transfers of beneficial interest in or legal title to real property are subject to this tax, and are based on the value of the real estate transferred. The tax is due at the time the deed is presented for recording and calculated and verified by a Real Estate Transfer Statement (Form 521) that must supplement the deed being presented.
